  1. According to the Washington, DC, Bureau of Justice Statistics, 4,024,087 people were on probation, 774,588 were on parole, and 2.1 million were in jail or prison in 2003.
  2. The incarceration rate of prisoners in 2003 was 482 per 100,000 residents, an increase from 411 in 1995. Among those states exceeding the national incarceration rate were Louisiana (801), Mississippi (768), Texas (702), and Oklahoma (636). Maine (149), Minnesota (155), and North Dakota (181) were among the lowest rates.
  3. The Eighth Amendment guarantees that "cruel and unusual punishment [not be] inflicted." The Eighth Amendment has been used to challenge the death penalty, three-strikes laws, crowded prisons, lack of health or safety in prisons, and excessive violence by the guards.

Prisons   

Prison refers to facilities where people serve their sentences for crimes committed. Jails are facilities that hold individuals who have not yet had a trial or received a sentence; individuals who receive very short sentences usually serve them in jails. The prison system has several goals: to punish people for criminal activity; to prevent future crimes by taking criminals off the street; to serve as a deterrent to other would-be criminals; and to rehabilitate, or reform, criminals.
